You are sitting happily in the den, watching your favorite team, when you open a letter that came in today’s mail. You are not very happy to learn that someone has claimed a prior ownership, and will be trying to take your home from you. Is this legitimate? Can they do this? In short: probably, and yes.
Your claim to your home rests in your Chain of Title. However, for any number of reasons, your Chain of Title may not be accurate. Someone who had a legitimate prior claim to the property may now be making a move to enforce their claim. If this is true, you have a real problem.
Further, your title insurance may not cover you for this person’s claim. The Schedule B exclusions may allow the insurer to deny coverage. If this is true, your problems just got a lot worse.
The very first thing you need to do is call a competent real estate lawyer. Not your uncle, the ambulance chaser. Then fill out the form to the right, and we will send you a document that may help.
